1. General Provisions and Acceptance of Terms

The website www.bullionbeasts.com (“Website”) is owned and operated by Bullion Beasts Limited (“we,” “us,” or “our”), a limited company incorporated in Hong Kong with its registered office at Unit B, 15/F, Wing Lok Street trade Centre, 235 Wing Lok Street, Sheung Wan, Hong Kong. By accessing or using the Website or our services, you (“Customer” or “you”) confirm that you accept these Terms and Conditions (“Terms”) and our Privacy Policy, and agree to comply with them. These Terms may be amended by us at our sole discretion without prior notice, and amendments are effective immediately upon posting on the Website. Your continued use of the Website or services after such amendments constitutes acceptance of the revised Terms. These Terms and all related policies are governed by the laws of Hong Kong, and any disputes shall be subject to the exclusive jurisdiction of the courts of Hong Kong.

2. Customer Eligibility and Registration

These Terms apply to any natural person who enters into a transaction for purposes predominantly outside their trade, business, or profession. By placing an order, you warrant that you are at least 18 years old, have full legal capacity, and are acting in your own name and for your own account, not as a representative of a third party. Certain services, such as vault storage, may require registration of an account, and you agree to provide accurate and complete registration information and maintain the security of your account credentials.

3. Order Process and Contract Formation

You may select precious metal items and/or storage services from our product range and add them to a shopping cart. Due to commodity price and exchange rate fluctuations, prices are valid for a limited period, indicated by a countdown timer on the Website. By clicking “Pay Now,” you submit an irrevocable binding offer to purchase the goods or services in the cart. We will send an automatic order confirmation by email, confirming acceptance of your order, subject to payment and availability. We reserve the right to reject any order at our discretion. A contract is formed only upon our acceptance, and we save the contract text for reference.

4. Payments

We accept payments in HKD and USD via Bank Wire, FPS (HKD only), Credit Card (up to HKD 100,000). All bank wire fees are borne by you, and payments must match the exact bank details provided. We reserve the right to refuse any credit card payment. Third-party payments are not accepted; all payment methods must match your registered details. Orders paid by Bank Wire or FPS receive a discount off the listed price, reflected on the Website. If payment is not received within 2 business days of order confirmation, we may cancel the order and retain any deposit as compensation for market loss.

5. Vault Storage Services

If requested, we will arrange allocated storage of your goods in a secure vault, where your goods are separately identifiable and segregated from other customers’ goods. To use this service, you must be a registered account user, provide verified ID, and maintain a direct debit or credit card recurring payment functionality, payable in advance as per the billing frequency notified at order placement. Storage fees are calculated at the time of purchase, with durations of 3 months, 6months and 12 months durations. Early termination of storage will forfeit any storage fees paid in advance. We use subcontractors to provide storage, ensuring they maintain appropriate insurance against loss, damage, or theft. Our liability is limited to enforcing rights against subcontractors on your behalf, with a maximum liability not exceeding the current market value of your goods at the time of loss, calculated on the third business day following notification. You may request delivery or collection of stored goods at any time, subject to payment of applicable fees and taxes. If storage fees remain unpaid, we may terminate the storage service, sell your goods to recover outstanding amounts, and refund any remaining balance. We reserve the right to terminate storage services with 90 days’ notice, after which unclaimed goods may be sold, with proceeds less fees sent to your payment account.

6. Shipping and Insurance

We fully insure all shipments against loss or damage in transit. Insurance coverage ceases once the carrier obtains a signature or completes delivery confirmation. You must not instruct carriers to leave parcels unattended or deliver to anyone other than the addressee, as neither we nor our insurer will be liable for such packages. If a package is lost or damaged in transit, we will file a claim with our insurer and, at our discretion, either reship the items or refund the purchase price. You agree to cooperate fully in any investigation, including providing reports or police filings if requested. Claims for issues with shipments must be reported to support@bullionbeasts.com with detailed photos and videos within two business days of receipt, or claims may be rejected. Shipping costs are borne by you, as indicated in the order form. If the delivered goods could not be delivered to the delivery address specified by you after two attempts, although the days of delivery were notified to you with reasonable prior notice, the delivery to you shall be deemed impossible and you shall bear all the costs incidental to such unsuccessful delivery and return. You shall bear the costs for the reshipment. The goods shall only be reshipped if you have first paid the additional costs for reshipping to us. If the additional costs are not paid by you within two business days of being requested to do so, we may withdraw from the contract. In this case, we shall reimburse you for the purchase price less all the costs incurred as soon as practicable.

7. Return Policy

Our return policy applies for five business days from the date you receive your items, excluding showroom pickup orders. Returns are accepted only for incomplete, missing, or incorrect orders. You must notify us at support@bullionbeasts.com within five business days, including detailed photos and videos, and keep items in original packaging. We will assess eligibility for return, refund, or exchange at our sole discretion. Approved returns will be refunded in full via the original payment method, excluding non-refundable shipping and handling charges. You are responsible for return shipping costs and the risk of loss during return transit. Non-compliant returns may be rejected.

8. Taxes and Duties

Prices quoted on the Website exclude customs duties, foreign taxes, or other costs associated with your order upon reaching the destination country. These are your sole responsibility, including obtaining import licenses and assisting local authorities with customs clearance. If you refuse to provide required documentation or pay duties, resulting in the parcel’s return, you bear all return shipping costs, duties, and taxes. We will reship only upon full payment of these costs. We declare the full shipment value on customs forms without exception.

9. Cancellation and Market Loss

Once an order is placed, it is a legally binding agreement and cannot be cancelled by you. We reserve the right to cancel any order at our discretion, including for suspected fraud, incorrect pricing, or non-payment within the allotted timeframe, and will refund you in full. If you fail to complete payment within three business days, you forfeit any deposit and are liable for any market loss, calculated as the difference between the order price and our current asking price, plus a HKD 300 administrative fee. Market gains on cancellations remain our property.

10. Buyback Policy

We may buy back precious metals purchased from us, provided they are in mint condition, including original packaging. Buyback prices are determined upon inspection at our office and locked in upon agreement. Products purchased elsewhere may be considered at different pricing, subject to review. You must deliver items in person to Unit B, 15/F, Wing Lok Street trade Centre, 235 Wing Lok Street, Sheung Wan, Hong Kong; postal or courier deliveries are not accepted. For items purchased from us, you may authorize another person to sell on your behalf by completing an authorization form with ID copies. Payments are made in HKD or USD (USD incurs a $50 fee) via bank transfer or cheque to your account only, within two to ten business days, depending on transaction size and bank processing times.

11. Limitation of Liability

To the fullest extent permitted by Hong Kong law, our liability for any claim arising from your use of the Website or services, including loss, damage, or theft of goods (except as covered by storage or shipping insurance), is limited to the amount paid by you for the goods or services. We are not liable for any indirect, consequential, or incidental damages, including loss of profits or opportunity, regardless of foreseeability. We are not liable for delays or failures due to force majeure events, including natural disasters, government actions, or other events beyond our reasonable control.

12. Data Privacy

We are committed to protecting your personal data in compliance with the Personal Data (Privacy) Ordinance (Cap. 486) of Hong Kong. Our Privacy Policy, available at www.bullionbeasts.com/privacy, details how we collect, use, and share your data. By using our Website or services, you consent to these practices. We may share your data with affiliates or service partners for order processing, subject to the Privacy Policy. You may withdraw consent, but this may prevent us from fulfilling your order, constituting a breach of these Terms.

13. Languages

In case of discrepancies between the English and other language versions of these Terms and content of this Website, the English version shall prevail.

14. Intellectual Property Rights

All contents (including but not limited to text, data, information, domain names, brand and trade names, logos, marks, designs, specifications, research and development, graphics, photographs, video and audio contents etc.) and features provided on this Website are protected by copyright, trademark and other forms of intellectual property/proprietary rights. Unless otherwise stated, Bullion Beasts is the legal and beneficial owner of this Website (including all subsisting intellectual property rights whether those rights are registerable or unregistrable) or a licensee of the copyright and any other intellectual property right of such contents published or otherwise made available on this Website from time to time.

15. Disputes and Notices

If you wish to dispute any matter related to these Terms, you may raise it in writing to Unit B, 15/F, Wing Lok Street trade Centre, 235 Wing Lok Street, Sheung Wan, Hong Kong, attention: Directors. We will respond within 20 working days. All notices under these Terms must be in writing. Notices to us must be sent by signed-for post or courier to Unit B, 15/F, Wing Lok Street trade Centre, 235 Wing Lok Street, Sheung Wan, Hong Kong. Notices to you will be sent to the verified address or email provided in your account. Notices are deemed delivered on the date signed for or, for email, upon transmission. Disputes are governed by Hong Kong law, with exclusive jurisdiction in Hong Kong courts.
